Terms of Service

1. Acceptance of Terms

By accessing or using NoQue's appointment booking platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

NoQue provides a cloud-native appointment booking platform that enables:

  • Citizens to book appointments with government departments and public services
  • Government departments to manage capacity and service delivery
  • Integration through embeddable widgets and APIs

3. User Accounts

3.1 Citizen Users

To make bookings, you must provide a valid phone number for OTP authentication. You are responsible for maintaining the confidentiality of your OTP codes.

3.2 Administrative Users

Administrative access is granted by partner organizations. Admin users are responsible for:

  • Maintaining the security of their credentials
  • All actions taken under their account
  • Compliance with POPIA and other regulations

4. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

  • Attempt to gain unauthorized access to the Service or related systems
  • Use the Service to transmit malicious code or spam
  • Impersonate another person or entity
  • Interfere with or disrupt the Service
  • Use automated means to access the Service without permission
  • Violate any applicable laws or regulations

5. Bookings and Appointments

5.1 Booking Confirmation

A booking is confirmed when you receive a reference number. You will receive SMS confirmation with your booking details.

5.2 Cancellations

You may cancel your booking through the Service. Cancellation policies vary by service provider. No-shows may affect your ability to make future bookings.

5.3 Service Provider Responsibility

NoQue facilitates bookings but does not provide the underlying government services. Service quality and delivery are the responsibility of the respective government department.

6. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which complies with POPIA. By using the Service, you consent to such processing.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by NoQue Pty Ltd and are protected by international copyright, trademark, and other intellectual property laws.

8. API and Widget Usage

8.1 API Access

If you use our API, you must:

  • Comply with API rate limits and usage guidelines
  • Keep your API keys confidential
  • Not use the API for unauthorized purposes
  • Attribute NoQue when required

8.2 Widget Embedding

Organizations embedding our widget must:

  • Have a valid partner agreement
  • Not modify the widget code
  • Display the widget in accordance with our guidelines
  • Comply with POPIA when collecting citizen data

9. Service Availability

While we strive for high availability, we do not guarantee that the Service will be uninterrupted or error-free. We may suspend or terminate the Service for maintenance, updates, or other reasons.

10. Limitation of Liability

To the fullest extent permitted by law, NoQue Pty Ltd shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or goodwill
  • Service interruptions or errors
  • Actions or omissions of service providers (government departments)

11. Indemnification

You agree to indemnify and hold harmless NoQue Pty Ltd from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party

12. Modifications to the Service

We reserve the right to modify or discontinue the Service at any time, with or without notice. We will not be liable for any modification, suspension, or discontinuation of the Service.

13. Changes to Terms

We may revise these Terms at any time by updating this page. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
